These Terms and Conditions are entered into between, on the one hand, Vignerons d'Exception SAS, with a capital of € 193,000, 71 rue François Mermet, 69160 Tassin la Demi-Lune, RCS Lyon 793 158 080, hereinafter referred to as "Vignerons d 'Exception".
On the other hand, all persons, physical or not, wishing to order one or more product offers proposed by Vignerons d'Exception, hereinafter referred to as "the customer".

These Terms and Conditions apply to all orders placed through the website www.vigneronsdexception.com and for all orders received by mail or telephone. Unless expressly agreed in writing by Vignerons d'Exception, no special conditions may prevail against these Terms and Conditions.
By placing an order, the customer acknowledges that he has read and agrees to these Terms and Conditions.

Price and order

Our offers are exclusively reserved for private customers, and under no circumstances to professional dealers.

Prices shown are in Euros, including all applicable taxes (including applicable VAT, excise taxes and any other applicable taxes). The displayed prices are net, excluding shipping and delivery costs (see "delivery" in these same Terms and Conditions). Vignerons d'Exception reserves the right to modify its prices and shipping costs at any time, however the products will be invoiced on the basis of the rates in effect at the time of the order registration and subject to availability.

Vignerons d'Exception undertakes to accept orders under the terms of these Terms and Conditions and within the limit of available stocks. All orders will be considered only after acceptance of payment by our bank (BNP PARIBAS). Vignerons d'Exception reserves the right to cancel all orders, non-compliant or doubtful, as well as those of a customer with whom there is a dispute relating to the payment of a previous order. By validating the order, the customer declares to have read and accept the present Terms and Conditions. The validation of an order is worth accepting these Terms and Conditions.

Product's availability and validity

In case of unavailability of one or more products after validation of the order, Vignerons d'Exception undertakes to inform the customer by e-mail or by telephone of the partial or total cancellation of his order.
If the payment has already been debited from the client's bank account, the undeliverable product (s) will be refunded as soon as possible (maximum one week) by crediting the credit card used to pay for the order, or by Cheque.

Delivery

For metropolitan France and Monaco only, Shipping is free for all orders over 400 € delivered at one address. For an order under 400, the fee is 20 € per address in continental France and 35 € per address in Corsica, and 50 € per adresse in Monaco.

Outside France, see hereunder and ask us if you can't find your country (telling us how many cardboxes of which wines you would like).

In France delivery takes one week, (2 weeks for Corsica and abroad), but in case of emergency tell us and we will see what we can do. Deliveries take place from Monday to Friday, during working hours.

To ensure a smooth delivery, we do need a phone number, which we will communicate to the carrier. Feel free to give us any detail that might help us or the carrier.

VERY IMPORTANT : Before signing the carrier's receipt, you must check every bottle and write every damage that could have happened or missing bottle. Otherwise insurance would not be able to work as they could say that damages have happened after the delivery. Tell us anything wrong as soon as possible.

You may change your mind and send back your order (in its original cardbox) within 15 days after receiving the wine. We will pay back the price of the bottles that will be received in good shape, but not the transportation cost for sending them back.

Change of delivery address : if your order has already left our cellar, and you want to change the delivery address, you will be charged 50 €.

Gifts : tell us when you send a gift. We have to send a lettre to the destinee in order to tell him that he is going to receive wine, and that he shouldn't refuse it because he has not ordered it (or to give him the time to change the delivery address if he wants to avoid the 50 € of last-minute-address-changing)

Out of France, we deliver with French Post or UPS in the following countries. Fees include special cardboxes, insurance and delivery.

Payment

The payment of the merchandise is done entirely at the order validation by credit card (Credit Card, Visa, MasterCard), checque (payable to Vignerons d'Exception) or transfer to the bank account of Vignerons d'Exception (IBAN: FR76 3000 4004 7500 0101 5312 105, BIC: EPS PP EN XXX).
By validating his order on the vigneronsdexception.com site, and choosing secured payment, the customer is directly connected to the BNP bank, which secures and ensures the transaction (notably the transmission of credit card data) via SSL encryption.
The customer guarantees that he is fully authorized to use the credit card used by him and that this credit card gives access to sufficient funds to cover the amount of the order.

Guarantee

The customer, if not satisfied with the ordered products, has a period of 15 days from receipt of his order to return it in its original packaging.
Returns are the responsibility of the customer and the price paid for the goods returned (including delivery charges if the entire order is returned) will be refunded to the customer by credit on the credit card used to pay for the order , or cheque, upon receipt of the return.

Retention of title

All our goods remain the property of Vignerons d'Exception wherever they are until the full payment of the invoices due. In the event of non-payment of the total price of the goods, Vignerons d'Exception may claim ownership of the products at the customer's expense and risk.

Protection of files

Vignerons d'Exception undertakes to secure and keep strictly confidential the personal information transmitted by its customers.
The prospects and customers file of Vignerons d'Exception was the subject of a declaration to the CNIL n ° 1678230v0. The information collected may be subject to external communication if the customer has given his consent at the time of his registration. This information may also be disclosed in order to comply with legal and regulatory requirements. Pursuant to Law No. 78-17 of 6 January 1978 "Data Protection and Freedom", the customer has the right to access, modify, rectify and delete data concerning him. Liability

Vignerons d'Exception has an obligation of means concerning the services offered to the customer, however its liability can not be incurred in the event of failure to fulfill one of its obligations due to facts beyond its control (strikes, catastrophes, computer breakdowns or hardware ...)

Protection of minors

Pursuant to Article L. 3342-1 of the Public Health Code, the sale of alcohol to minors under the age of sixteen (16) years is prohibited. The customer agrees to be 18 years old when placing an order.
